1. Introduction & Acceptance

Welcome to Subh Location. These Terms & Conditions ("Terms") are a legally binding agreement between you ("User", "you", "your") and GLOW INFOWAY ("we", "us", "our"). By installing, accessing or using the Subh Location mobile application ("App") you accept and agree to be bound by these Terms. If you do not agree with any part of the Terms, do not use the App and uninstall it immediately.
These Terms constitute an electronic record under applicable law and do not require any physical signature. They apply to all users of the App on iOS, Android and any other platform where the App is distributed.

3. Scope of Services — What Subh Location Is
Subh Location is an informational real-estate and locality discovery application that helps users browse localities, view property listings (as provided by third parties or users), explore locality insights, and personalize content based on selected cities and preferences.
The App is intended only for browsing, discovery and informational purposes. It does not and will not act as a broker, agent, or legal advisor for property purchase, sale or lease. Where actionable transactions (e.g., booking, payments, or broker agreements) are required, Users must complete those actions outside the App and with their chosen providers or agents.
4. No Payments / No Payment Gateways
IMPORTANT: Subh Location does NOT provide any payment processing, payment gateway, or in-app purchase mechanism. The App does NOT accept or process payments, subscriptions, deposits, or service fees.
If you are offered or asked to provide payment details inside the App, those offers are not authorized by us. We will never request credit/debit card data, UPI IDs, bank account details or payment credentials through the App.
If we introduce paid services in the future we will clearly disclose such services, obtain explicit consent from Users, and publish an updated Terms and clear payment terms. Until then, all functionality offered in the App remains free of charge.
5. Account Registration & OTP Authentication
Some features of the App require registration using a mobile phone number. Authentication for account creation and login is performed using One Time Passwords (OTP).
We use third-party providers to deliver OTPs: SMS delivered via providers such as Fast2SMS and messaging-based delivery via WhatsApp Business API (or other official WhatsApp API providers). By providing your phone number you consent to receiving automated OTP messages for authentication.
We store only the minimal required information for authentication and account association. You are responsible for maintaining the confidentiality of access to your phone number and any device that receives OTPs. Anyone with access to your phone number may be able to access your account.
We may implement rate limits, blocking, or additional checks to prevent abuse or excessive OTP requests. Excessive or suspicious behavior may cause temporary blocking or permanent suspension of the account.
6. Data Collection, Analytics & Privacy (Summary)
Subh Location uses Firebase Analytics for aggregated and anonymized analytics, crash reporting, performance monitoring and product improvement. This helps us understand usage patterns, fix crashes, and make the App better.
Types of data we may collect: device model, operating system version, app version, anonymized usage events, crash logs, time of use, and basic device identifiers. We may also store profile information you voluntarily provide such as name, email, role (e.g., broker, buyer, builder), and selected city preferences.
We DO NOT collect payment information (credit/debit card numbers, UPI, bank details).

6.1 Location Access (Earlier Versions)
Earlier versions of the App may have requested access to your device’s approximate location to help users view relevant local property listings. This permission has been removed in the latest update, and the App no longer collects, tracks, or processes any location data of any kind. The App does not access GPS or precise location.
7. User Conduct, Content & Prohibited Actions
When using the App you must comply with applicable laws and these Terms. You agree not to:
- Provide false or misleading information; misuse someone else’s identity;
- Upload, post, or transmit content that is illegal, defamatory, obscene, hateful, harassing, pornographic, or that violates the rights of others;
- Scrape, crawl, use automated tools, bots or scripts to access the App or harvest data;
- Reverse-engineer, decompile, disassemble, or otherwise attempt to derive source code or internal logic from the App;
- Attempt to bypass authentication, authorization, or security controls, or interfere with the operation of the App or the servers that host it.
We reserve the right to remove content that violates these Terms, and to suspend or terminate accounts engaging in prohibited activities.
8. Intellectual Property Rights
All intellectual property rights in the App, including but not limited to source code, design, graphics, logos, text, images, trademarks, and trade names are owned by or licensed to Glow Infoway.
Except for the limited license to use the App as provided under these Terms, you acquire no right, title, or interest in the App’s content. You may not copy, reproduce, republish, upload, post, transmit, or distribute any material from the App without prior written permission from us.
9. Third-Party Services & Links
The App may integrate or display content from third-party services such as Google Maps, Firebase, Fast2SMS, WhatsApp API providers, and other APIs. These third parties may collect or process data subject to their own terms and privacy policies.
We are not responsible for the behavior, content, or privacy practices of third-party providers. Integration does not imply endorsement.
Where the App includes links to external sites or services, we do not control those sites and are not responsible for their content or privacy practices. Accessing external links is at your own risk.
10. Disclaimers & No Warranty
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, NON-INFRINGEMENT, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLOW INFOWAY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED ANY AMOUNTS PAID BY YOU TO US (IF APPLICABLE). SINCE THERE ARE CURRENTLY NO PAID SERVICES, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
12. Indemnity
You agree to indemnify, defend, and hold harmless Glow Infoway and its affiliates, officers, directors, employees and agents from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your breach of these Terms, your use of the App, or your violation of any law or the rights of any third party.
13. Suspension, Termination & Account Deletion
We may suspend, restrict, or terminate your access at our sole discretion for any reason, including but not limited to breach of these Terms, suspected fraud, or technical problems. Where possible, we will notify you of the reason for suspension or termination.
You may request deletion of your account by contacting support. Upon deletion we will remove your account and associated profile data where technically feasible; however anonymized analytics data and aggregated statistics may be retained for internal business purposes.
14. Changes to the App & Terms
We reserve the right to update or modify the App, its features, and these Terms at any time. We will post the updated Terms within the App and indicate the Effective Date. Continued use of the App after changes constitutes acceptance of the updated Terms. We encourage you to review the Terms periodically.
15. Governing Law, Dispute Resolution & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any dispute, controversy or claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Rajkot, Gujarat, India.
Before initiating formal legal proceedings, you and we agree to attempt to resolve the dispute informally by providing written notice to the other party. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue other remedies available under law.
16. Security & OTP Abuse Prevention
We implement reasonable technical and organisational measures to protect account data and authentication processes. We may throttle or limit OTP requests, block suspicious IP addresses or devices, and introduce captchas or additional verification if abuse is detected.
Despite such measures, no system is fully secure. You should not rely solely on the App for highly sensitive or critical decisions without independent verification.
17. Accessibility & User Experience
We aim to make the App accessible and usable for as many people as possible. If you face any accessibility issues or need assistance accessing features, please contact our support team and we will make reasonable efforts to help.

19. Entire Agreement
These Terms constitute the entire agreement between you and Glow Infoway with respect to your use of the App and supersede all prior or contemporaneous understandings and agreements, whether written or oral.
20. Severability
If any provision of these Terms is held to be invalid, illegal or unenforceable, the remaining provisions will remain in full force and effect and the invalid provision will be replaced by a valid provision that most closely matches the economic purpose of the original provision.

By using the App you acknowledge that you have read, understood and agree to these Terms & Conditions.
